These Terms & Conditions (“Terms”) govern your access to and use of the EcoFabric Trace™ website and platform (“Services”).

By accessing or using our Services, you agree to comply with these Terms. If you do not agree, you must not use our Services.

 
1. About EcoFabric Trace™

EcoFabric Trace™ provides a platform for Digital Product Passport (DPP), supply chain traceability, and compliance infrastructure designed for brands, manufacturers, and supply chain stakeholders.

 
2. Acceptance of Terms

By accessing or using our website or Services, you agree to be bound by these Terms and all applicable laws and regulations.

 
3. Use of Services

You agree to use the Services lawfully and responsibly. You must not:

  • Use the platform for unlawful, fraudulent, or misleading purposes
  • Interfere with the security, operation, or performance of the Services
  • Attempt unauthorised access to systems, accounts, or data
  • Provide false, inaccurate, or misleading information
  • Misuse supply chain, compliance, or verification data
 
4. Early Access Program

EcoFabric Trace™ may provide access to certain features through an Early Access program.

By participating, you acknowledge that features may be evolving, incomplete, or subject to change. Service availability may be limited, and feedback may be requested to improve the platform.

We reserve the right to modify or discontinue Early Access at any time.

 
5. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

You agree to provide accurate and up-to-date information and must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that breach these Terms.

 
6. Data and Content

6.1 Ownership of Data

You retain ownership of all data you provide, including product, supply chain, and compliance-related information. EcoFabric Trace™ does not claim ownership of your data.

6.2 Licence to Use Data

You grant EcoFabric Trace™ a limited, non-exclusive licence to process your data for the purpose of operating, maintaining, and improving the Services, including generating Digital Product Passports and supporting compliance workflows.

6.3 Responsibility for Data

You are responsible for ensuring the accuracy, completeness, and lawful use of any data you provide, including obtaining any necessary permissions.

 
7. Data Processing and Compliance

EcoFabric Trace™ may act as a data controller for website and account-related information, and as a data processor for supply chain and compliance data processed on behalf of customers.

The platform supports structured data aligned with global standards, and may integrate with third-party verification providers. However, customers remain responsible for correct implementation, compliance outcomes, and regulatory use of the data.

 
8. Third-Party Services

Our Services may include integrations with third-party providers. These providers operate under their own terms and may process data independently. EcoFabric Trace™ is not responsible for third-party services.

 
9. Intellectual Property

All intellectual property rights in the platform, including software, design, content, and branding, remain the property of EcoFabric Trace™ or its licensors.

You must not copy, modify, distribute, or reverse engineer any part of the platform.

 
10. Availability of Services

We aim to provide reliable access to the Services but do not guarantee uninterrupted availability. We may update, modify, or suspend features as part of ongoing platform development and maintenance.

 
11. Disclaimer

The Services are provided on an “as is” and “as available” basis. EcoFabric Trace™ does not guarantee the accuracy, completeness, or reliability of data, nor any specific compliance outcomes.

 
12. Limitation of Liability

To the extent permitted by law, EcoFabric Trace™ is not liable for any indirect or consequential losses, including loss of data, revenue, or business opportunities.

Total liability is limited to the amount paid (if any) for the Services.

 
13. Indemnity

You agree to indemnify and hold EcoFabric Trace™ harmless from any claims, damages, or liabilities arising from your use of the Services, breach of these Terms, or provision of inaccurate or unlawful data.

 
14. Data Processing Agreement (DPA)

Where applicable, EcoFabric Trace™ may enter into a Data Processing Agreement (DPA) governing the processing of personal data, including security measures and cross-border data transfers.

 
15. Service Level Agreement (SLA)

Enterprise customers may be provided with a Service Level Agreement (SLA), covering platform availability, support, and performance. SLA terms apply only where explicitly agreed.

 
16. Termination

We may suspend or terminate access to the Services where necessary, including in cases of breach, legal risk, or security concerns.

You may stop using the Services at any time.

 
17. Privacy

Your use of the Services is also governed by our Privacy Policy.

 

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

You agree that any disputes arising out of or in connection with these Terms or the Services will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

 
19. Changes to Terms

We may update these Terms from time to time. Updated versions will be published on this page with a revised effective date.
